Under this program Nintendo can claim content that's covered under fair use like news and reviews. Nintendo is way out of line here.

Nintendo is not doing this for the money. The amount of money involved does nothing for Nintendo. This about control. Controlling the message and controlling the critics.

I have to disagree that if someone is using a tool, then the maker of the tool should get the profits. The content of these YouTube videos isn't the game, it's what the players are doing and saying while playing the game.

That's like saying if I create a video in front of the White House, the government gets a cut of the profits. Or how about if someone creates a video called "Me Drinking a Coke", which is just them opening a can of coke and drinking it. Does Coke get the money?

If anything, this is free advertising for these companies, and they are shitting all over it.

Not smart.

I completely agree.

For the record; I have a YouTube channels I use for trailers when I need to. But it is not monetized.

I typically follow Fair Use laws with my videos, transforming the original media and only using 15~30 seconds of footage at a time. Nintendo should not be able to claim any of my revenue because I'm covered by that law...

If Nintendo does...then that would be like movie studios getting a part of the ad revenue from a Movie Review on NBC. That would be ridiculous

If you took a recording of a movie, then super-imposed you and friend talking over watching that movie and uploaded the film in its entirety, do you think the movie studio wouldn't be entitled to any licensing or copyright claims?

We're not talking Adobe getting a cut of every film edited with its software, that'd be ludicrous. We are possibly talking about publicly sharing a cinematic experience that people are expected to pay to see. I'm not saying games are 100% like that--there's a difference between a 'let's play' of Uncharted's SP and Mario Kart--but there is some questionable grey area.

Nintendo's approach might be a little extreme, and I'm not saying I agree with it. Just saying it does feel like there's a line that should be drawn somewhere.

Haha. I don't think I will. The only difference in my mind is that I can post stuff to the front page now. I'll do what I can when I can. Well, I see your point, but to me that is comparing apples to oranges. The consumption of movie content is through watching. The consumption of gaming content is playing. That analogy would work if yootoobers let other people play their game while they talked over it. In that case, the audience would be consuming the content, and Nintendo would be correct. But these guys are not letting other people play the game.
